| How does the point system work?
|
|
Most of the immigrants who are
not refugees or family class members come to Canada under a point system. The
point system requires you to score at least 70 points to qualify to come to
Canada. The point system is not entirely a mechanical process. It aims at
finding people who will adjust to life in Canada. Points are given for
education, experience, age, relations in Canada, language ability in English
and French, demand for the occupation of the applicant, approved job letter and
the interview.
Before we undertake to do your application we will assess your eligibility and
take the case if we feel that you will qualify. The final decision to approve
the application is with the immigration officer.
|
| Who can immigrate to Canada? |
|
The largest number of people
who immigrate to Canada are in the independent category in which the person
applying has skills and experience required in Canada. The next category of
immigrants is self employed, entrepreneur and investors who have the skills and
business experience. There is no fixed amount required to qualify under the
entrepreneur category. However, it is advisable to have at least CN $ 250,000.
Investors are required to show capital of CN $ 800,000 and invest in a
government approved project CN $ 400,000. The next category is that of
dependents, who are either wife or children of the applicant or parents or
grandparents. There is also a refugee class under which those who are under
threat of personal security in their home country can apply
|
| How long does it take to become landed? |
|
The time frames to become
landed depends on where you apply. If you apply in some countries like India,
China or Iran it takes between one or two years from the date of application to
get an interview and a further about 2 months to get the landed visa. If you
apply from countries like Paris, Berlin or London the time period is between 6
months to one year. You can apply to be interviewed in another country even if
you do not live there.
In our experience a lot of time is lost in collecting the documents needed,
incomplete information on the forms and mistakes in the application submitted.
For each piece of missing information one or two months may be lost.

| Can I live in my home country after I have landed in Canada?
|
|
You can visit your home country
after you have become landed but if you stay away from Canada for longer than 6
months you must obtain a Returning Resident Permit. If you have stayed in
Canada and become a Citizen of Canada you can live as long as you wish outside
Canada and return to Canada any time. It takes about three years and a test to
become a Citizen in Canada.
|
| What are the typical steps in an immigration file?
|
|
Step 1
The first step is sending us
the short checklist of information. This enables us to make an assessment of
your eligibility to immigrate to Canada. We will not proceed with your file if
you are not likely to succeed in immigrating under the point system. We will
determine the category under which you will come.
Step 2
We will negotiate the fees with you and prepare a retainer. You should sign the
retainer and fax it to us and mail the first installment of the cheque to us.
If you are working through an agent he will discuss the fees with you and
receive the first installment of fees from you.
Step 3
You should prepare all the documents as set out in the checklist of documents
and send two copies of all the documents to us. Please keep the originals with
you except for the police certificates. For police certificates we should have
the originals and you should keep copies.
Complete the application forms in your handwriting and sign the last page in
the correct places. Send these completed forms to us along with your documents.
The cheque for the Immigration should be made out to “Receiver General of
Canada” for the correct amount.
Step 4
We counsel will prepare a submission on your behalf and organize the documents.
If any documents are missing we will send a list of missing documents to you.
Please make sure that all the missing documents are sent to us at one time.
Your submission will be prepared and the documents will be sent to the
immigration office where you wish to be interviewed.
Step 5
There will be an acknowledgement of the application which will be mailed to us.
We will advise you of the acknowledgement. If it is mailed to you please fax us
a copy of the acknowledgement. It contains the file number given to your
application.
Step 6
There is a long wait before an interview date is given. It is about a year in
most European capitals and US and about 2 years in Middle East and Asia. We
will require the second instalment of fees paid as set out in the retainer
before the date is provided to you. If there is an agent the fees may be paid
to the agent and the agent will provide the interview date to you.
Step 7
You should prepare and travel to the place of interview. It will be your
responsibility to arrange a visa and make travel arrangements to the place of
interview. Please call us a week before the date of interview and we will
prepare you for the interview on the phone. You should read the memo on
interview on our website.
Step 8
Within about 2 months the immigration will usually advise if you have been
accepted. Medicals will be sent to us and we will forward these to you. You
should take the medical documents to the approved doctor in your area and he
will send the medical report directly to the immigration office.
Step 9
Visa will be issued and sent to us. We will advise you that visas have been
issued. You should send all the balance of the fees before we send the visas to
you.
Step 10
You should arrive in Canada and become landed and your visa will be stamped.
From June 2002 a landing card will be issued showing your landed status.
Step 11
We will look forward to meeting you in our office and discuss after landing
services. We can refer you to employment agency or assist you to start business
through our counsel. |
